American Creek Provides Treaty Creek - Teuton Resources Corp Litigation Update
CARDSTON, ALBERTA--(Marketwired - Dec 22, 2014) - American Creek Resources Ltd. (TSX VENTURE:AMK) ("American Creek" or "the Corporation") wishes to provide an update on recent events related to the ongoing litigation with Teuton Resources Corp. ("Teuton") over the Treaty Creek property.
On November 26, 2014, Reasons for Judgment were delivered by the trial judge on the matter of costs in the Treaty Creek litigation. The judgment directed that Teuton is to pay American Creek certain costs and special costs (see the Corporation's news release dated November 27, 2014). American Creek reports that it has received no payment from Teuton since that judgment was delivered.
The appeal proceedings in the Treaty Creek litigation are scheduled to be heard in the British Columbia Court of Appeal on January 19-21, 2015. The Corporation is confident in the decision of the British Columbia Supreme Court and expects that it will also prevail in the Court of Appeal.
American Creek also advises that Holmes & King, Teuton's present legal counsel, has served the Corporation with a Notice of Motion in which Holmes & King is applying to the court to withdraw from representing Teuton due to "professional and other differences" and an affidavit stating that Holmes & King "has terminated its services and its lawyer-client relationship with Teuton". The motion has been scheduled for December 23, 2014. The Corporation is uncertain at this time how this may or may not affect the appeal proceedings scheduled in January. It should be noted that prior to Teuton retaining Holmes & King, Teuton's previous legal counsel, Davis LLP, also served the Corporation with a notice of intention to withdraw as Teuton's legal counsel. Holmes & King is the third legal counsel that Teuton has retained during the course of the Treaty Creek litigation.
